ORGANIZING AUTHORITY
The organizing authority (OA) is Red Bull North America.
PREAMBLE
Specific attention is drawn to the Racing Rules of Sailing (“RRS”), Fundamental Rule 4, that states: “The responsibility for a boat’s decision to participate in a race or to continue racing is hers alone.” For full RRS, see https://www.racingrulesofsailing.org/rules.
Sailboat racing is a hazardous activity. Anyone intending to participate in or become involved with the Red Bull Foiling Generation Series of events (the “Series”) either as a participant, crew member, team member, or otherwise does so at their own risk and such individuals must recognize that they may suffer injury, loss of life, and/or loss or damage as a result of such involvement.
The OA, Sponsor, Event and Series managers, the Flying Phantom Class, World Sailing, US Sailing, and any other party involved with the Organization of the Series disclaim to the maximum extent permitted by law any and all responsibility whatsoever for any loss, damage, injury or inconvenience that might occur to persons and goods, both ashore and on the water, as a consequence of participation in the Series.
Those participating in or otherwise voluntarily becoming involved with the Series recognize that such exclusions and indemnities on the part of and for the benefit of the OA and others involved in the management and organization of the Series (including, without limitation the Series sponsors) are appropriate and reasonable in the circumstances and recognize their own obligation to secure appropriate insurance and to bring this notice and these exclusions and indemnities as well as those set out below, including those in the Commercial Agreement, to the notice of any third party whom they involve or seek to involve in any way in the Series.
RISK STATEMENT
RRS Fundamental Rule 4 states: “The responsibility for the boat’s decision to participate in a race or to continue racing is hers alone.”
Sailing is by its nature an unpredictable sport and therefore inherently involves an element of risk. By taking part in the
Series, each competitor agrees and acknowledges that:
(a) They are aware of the inherent element of risk involved in the sport and accept responsibility or the exposure of themselves, their crew, and their boat to such inherent risk whilst taking part in the Series;
(b) They are responsible for the safety of themselves, their crew, their boat and their other property whether afloat or ashore;
(c) They accept responsibility for any injury, damage or loss to the extent caused by their own actions or omission;
(d) Their boat is in good order, equipped to sail in the Series and they are fit to participate;
(e) The provision of a race management team, patrol boats, and other officials and volunteers, as selected is the OA's sole discretion, does not relieve them of their own responsibilities;
(f) The provision of patrol boat cover is limited to such assistance, particularly in extreme weather conditions, as can be practically provided in the circumstances;
(g) They are responsible for ensuring that their boat is equipped and seaworthy so as to be able to face extremes of weather; and there is crew sufficient in number, experience and fitness to withstand such weather; and that the safety equipment is properly maintained, stowed and in date and is familiar to the crew.
INSPECTIONS
The technical committee (see RRS 92) appointed by the OA, will conducts inspections of a boat. This does not reduce the responsibility of each competitor set out in the Notice of Race and Sailing Instructions.
1 RULES
1.1 The regatta will be governed by the rules as defined in The Racing Rules of Sailing 2017-2020.
1.2 The following prescriptions of US Sailing will not apply: 63.2, 63.4, and 82.
1.3 The following documents also govern the event:
– Red Bull Waiver and Release
– World Sailing Addendum Q as amended by the Sailing Instructions (SIs) (a copy of Addendum Q is available at: http://www.sailing.org/tools/documents/AddendumQversion20170612-[22902].doc)
–Rules for Handling Boats, to be provided in the sailing instructions.
1.4 The class rules of the Flying Phantom class will not apply.
1.5 If there is a conflict between languages the English text will take precedence.
1.6 The notation ‘[DP]’ in a rule in this Notice of Race (NoR) means that the penalty for a breach of that rule may, at the discretion of the protest committee, be less than disqualification.
1.7 [DP] Competitors shall, at all times while afloat, except briefly while changing or adjusting clothing or personal equipment, wear a personal flotation device (PFD) and a helmet. The OA reserves the right to reject any PFD or helmet which it considers unsuitable.
2 [DP] ADVERTISING
2.1 Competitor advertising must be approved by organizing authority.
2.2 Boats will be required to display advertising chosen and supplied by the organizing authority. If this rule is broken, World Sailing Regulation 20.9.2 applies.
3 ELIGIBILITY AND ENTRY
3.1 The provided boats are Flying Phantom type boats to be sailed with 2 crew members.
3.2 Age: Each crew member shall be born in the years 1997-2001. In the event any crew member is under the age of
18 or a minor in the jurisdiction of the Event, such crew member’s parent or legal guardian must be present on site during the Event.
3.3 Nationality: Each crew member must have a valid United States passport and may only enter one (1) Red Bull Foiling Generation event for qualification to the Red Bull Foiling Generation Final.
3.4 Eligible teams may apply by completing the application form located on www.redbull.com/foilinggenerationmiami no later than September 10, 2018.
3.5 No late entries will be accepted.
3.6 Limited to 16 teams (32 sailors)
4 FEES
4.1 Upon Acceptance, required fees are as follows:

Teams that are accepted must also provide to the OA a damage deposit of $500.00 4.3 Fees will be payable to OA, as indicated in Letter of Invitation.
5 SCHEDULE
5.1 Registration: Wednesday, October 31, 2018, from 0900 to 1000.
5.2 Training Day: Thursday, November 1
5.3 Dates of racing: Friday, November 2 - Sunday November, 4, 2018
5.4 The scheduled time of the first warning signal for each day is 1000.
6 MEASUREMENT
6.1 All boats will be provided by OA.
7 SAILING INSTRUCTIONS
7.1 The sailing instructions will be available after October 15 at www.redbull.com/foilinggenerationmiami
8 VENUE
8.1 The regatta will be sailed in the vicinity of East Fishing Pier on Key Biscayne, Florida
9 THE COURSES
9.1 The diagrams in Attachment show an example of the possible courses, including the approximate angles between legs, the order in which marks are to be passed, and the side on which each mark is to be left.
10 PENALTY SYSTEM
10.1 Pending approval from US Sailing and in accordance with RRS 70.5(a), decisions of the protest committee are final.
11 SCORING
11.1 There will be a single-elimination series of races with four (4) teams racing each other. The two (2) top teams in each race will advance to the next round until there is the final race where the first-place team in the final race is the winner of the Event.
11.2 The OA can modify this format at any time to ensure the completion of the Event based on conditions. This could include the use of seeding, elimination, or addition of brackets to ensure a fair and complete Event.
12 [DP] SUPPORT AND SPECTATOR BOATS
12.1 Spectator vessels shall register and shall be marked with a flag provided by the OA. These vessels shall stay outside of areas where boats are racing and shall not communicate with competitors while afloat.
12.2 No private support / coach vessels are allowed.
13 [DP] BERTHING
13.1 Boats shall be kept in their assigned places while they are in the boat park.
14 [DP] RADIO COMMUNICATION
14.1 Except in an emergency, a boat that is racing shall not make voice or data transmissions and shall not receive voice or data communication that is not available to all boats.
15 PRIZES
15.1 Prizes will be given as follows:
1st ,2nd, 3rd place teams will receive a Trophy.
Winner will compete in the Red Bull Foiling Generation Global Finals in Key Biscayne, FL November 7-11, 2018. (2nd place team will take over if the 1st place cannot compete.)
16 DISCLAIMER OF LIABILITY
16.1 Competitors participate in the regatta entirely at their own risk. See RRS 4, Decision to Race. The organizing authority will not accept any liability for material damage or personal injury or death sustained in conjunction with or prior to, during, or after the regatta.
16.2 Please see attached required Red Bull Waiver and Release. This is required to be completed in entirety by all participants competing in the regatta as well as guardians / parents attending.
17 INSURANCE
17.1 Each participating boat shall be insured with valid third-party liability insurance with a minimum cover of $500,000 per incident or the equivalent.
