THIS PROMOTION IS DESIGNED AS A PHYSICAL SKILL COMPETITION. VOID WHERE PROHIBITED BY LAW. USE CAUTION AND COMMON SENSE WHEN PARTICIPATING IN THIS COMPETITION. RESPECT AND ENSURE THE SAFETY OF YOURSELF AND OTHERS.
NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.
THIS COMPETITION IS A SERIES OF IN-PERSON EVENTS. ANYONE FEELING SICK, WITH A TEMPERATURE AT OR ABOVE 100.4° F, OR WITH KNOWLEDGE THEY HAVE BEEN IN CONTACT WITH SOMEONE WITH COVID-19 SHOULD STAY HOME AND FOLLOW CDC GUIDANCE AND LOCAL HEALTH & SAFETY REGULATIONS AND GUIDANCE WHERE ANY EVENT IN THIS COMPETITION TAKES PLACE TO PREVENT THE SPREAD OF COVID-19. FACEMASKS AND SOCIAL DISTANCING MAY BE REQUIRED FOR ALL PARTICIPANTS. PARTICIPANTS SHALL COMPLY WITH ALL ON-SITE SAFETY PROTOCOLS. PERSONS DEVELOPING OR EXHIBITING SYMPTOMS OF COVID-19 OR BREAKING SAFETY PROTOCOLS MAY BE DENIED ENTRANCE TO AND/OR DISQUALIFIED FROM AN EVENT AND SENT HOME.
ELIGIBILITY: The Red Bull Run the Racks 2023 (the “Tour”) begins on January 21, 2023 and ends on December 19, 2023 (the “Contest Period”) and consists of a live tour which includes stops around the nation at various participating locations,* subject to change in Red Bull’s sole discretion (each, a “Tour Event”). All times and scores shall be determined by Sponsor’s timekeeping and scorekeeping systems. Sponsor shall have the sole discretion in determining the score or the timeliness of any action or inaction related to this Tour. All times mentioned in these Official Rules shall be Pacific Time unless expressly noted otherwise.
*All dates and locations subject to change. Locations for each Tour Event will be announced at https://www.redbull.com/us-en/event-series/red-bull-run-the-racks.
Each Tour Event consist of a live contest where participants compete by shooting basketballs to accumulate as many points as possible in 70 seconds. Participating in a Tour Event is open to individuals who (i) are legal residents of the U.S. (including D.C.); and (ii) who are at least eighteen (18) years old and the age of majority in their jurisdictions of residence as of the date of entry. Void where prohibited. Employees of Red Bull North America, Inc. (“Sponsor”) and its parent companies, subsidiaries, affiliates, advertising agencies, public relations agencies, prize suppliers, including any vendors providing services in connection with this Contest (collectively, the “Sponsor Affiliates”), Position Sports, Inc., and employees, agents, directors, officers (including members of their immediate family – i.e., spouse, mother, father, in-laws, grandmother, grandfather, brother, sister, children and grandchildren – or those living in the same household) of Sponsor or any Sponsor Affiliates are not eligible to participate in any Tour Event. Tour Events are subject to all applicable federal, state, and local laws. NCAA Division I, II, or III athletes are permitted to compete in the Tour Events, provided however that any such participant is excluded from receiving any prizes. Notwithstanding the foregoing, all athletes must first confirm with their respective athletic departments and universities/colleges to ensure there is no risk to eligibility by participating in one or more Tour Events. SPONSOR AND SPONSOR AFFILIATES ARE NOT RESPONSIBLE FOR DETERMINING THE NCAA ELIGIBILITY OF ANY COMPETITOR.
By entering and/or participating, entrants agree to be bound by these Official Rules and Sponsor’s Privacy Policy as set forth in these Official Rules.
HOW TO REGISTER AND COMPETE: To register to participate in a Tour Event, visit the local participating location on the day of the event and fill out the official entry form with all required information. Each Tour Event is subject to local restrictions (including, without limitation, a maximum number of registered participants). After registration, each eligible registered participant will have at least one (1) opportunity to participate in the “Qualifying Round,” where they shoot twenty-five (25) official NBA or WNBA basketballs (as applicable), provided by Sponsor, and make as many baskets as possible within 70 seconds.
At select Tour Events, as determined in Sponsor’s and/or event director’s sole discretion, additional opportunities and rounds of competition may be offered. The number of opportunities and rounds of competition will be determined based on the total number of eligible participants for the applicable Tour Event. For Tour Events with multiple rounds of competition, the Tour Event will proceed as a bracket competition, with the highest scores advancing to subsequent rounds, as determined in Sponsor or event director’s discretion.
The contest is split into two (2) divisions—Men’s and Women’s. The men will shoot from the NBA’s 3-point line with NBA regulation size basketballs and the women will shoot from the WNBA’s 3-point line with WNBA regulation size basketballs. If a participant shoots from in front of the applicable 3-point line, the participant will not receive credit for the basket and will not receive a replacement ball. The winner will be determined by who, in Sponsor’s sole discretion, makes the most baskets in the allotted time. In the event multiple participants tie for the number of baskets made, the participant achieving the tied score in the shortest amount of time, as verified in Sponsor’s sole discretion, will be declared the winner. If participants are still tied after the first tie-break, the tied participants will compete in a sudden-death shoot-out. A coin flip will determine the order of participants. Each participant will attempt to make one three-point shot and the other participant(s) will have one chance to match. If the first participant makes their shot and the subsequent participant(s) miss, the participants missing their shot(s) will be eliminated. If the tied participants make their shots, the process will repeat. If no participants make their shots, the process will repeat until one player makes a shot.
Each participant will have their verified scores and times posted to the Run the Racks leaderboard, available at https://www.redbull.com/us-en/event-series/red-bull-run-the-racks. For tour Events with multiple rounds, the top scores regardless of round will be posted to the Run the Racks leaderboard. On or about December 20, Sponsor will determine which of the participants in each division, from among all Tour Events, is the national winner (the “Grand Prize Winner”).
Sponsor reserves the right in its sole and unfettered discretion to disqualify any entry that it believes did not comply with these Official Rules, or that is not consistent with the spirit or theme of the competition. Sponsor is not responsible for lost, late, misdirected entries or entries not received regardless of cause. In the event of a dispute over who submitted an entry, Sponsor will determine the identity of the entry in its sole discretion. Entries become the property of Sponsor and will not be returned. By entering, attempting to enter, or otherwise participating in this Tour, you agree to be bound by these Official Rules.
WINNER SELECTION: Subject to verification and compliance with these Official Rules, the eligible participants in each of the Men’s and Women’s divisions with the highest total score in the Qualifying Round will be selected as the Qualifying Round winner. There will be up to three (3) Qualifying Round winners per Tour Event per division.
Subject to verification and compliance with these Official Rules, the eligible participants in each of the Men’s and Women’s divisions from among all Tour Events with the highest total score will be selected as the Grand Prize Winners. There will be one (1) Grand Prize Winner per division.
PRIZES: Qualifying Round or tournament prizes (as applicable) will be awarded to the men’s and women’s participants.
Medals:
- First Place: First place medal
- Second Place: Second place medal
- Third Place: Third place medal
- Approximate Retail Value (“ARV”): $50 each
The verified Grand Prize winners will receive the following prizes:
Athlete experience, including
- Basketball training session with Red Bull Athlete Chris “Lethal Shooter” Matthews
- Sessions will consist of approximately 2 hours and 30 minutes of training
- Round-trip, economy travel for winner to Santa Monica, CA
- Accommodations (standard room(s), occupancy, and hotel determined in Sponsor’s sole discretion)
- ARV: $10,000 each
Limit: one (1) prize per person.
The approximate retail value of all prizes to be awarded in this Contest is $20,000.
Tax Gross-Up Payment: For the Grand Prize winners, Sponsor will also provide each winner a single cash payment in the form of a corporate check, which is intended to assist the winners with any federal, state, or other tax obligations related to the prizes (the “Tax Gross-Up Payment”). The winners’ actual tax liabilities related to the prizes could exceed the Tax Gross-Up Payment the winner receives. The winners are solely responsible for all applicable federal, state, or other tax obligations related to the prizes. Sponsor will not provide any further assistance toward the winner’s tax obligations.
In the event that a winner is a NCAA Div. I, II, or III athlete, the winner will not receive the prize. Prizes are not awarded due to NCAA athletic conflicts will be awarded either such athlete’s university/college or to a charity in Sponsor’s sole discretion.
All prizes are awarded “AS IS.” Neither Sponsor nor Sponsor Affiliates make or offer any warranty or guarantee, either express or implied (including, without limitation, quality, merchantability, and fitness for a particular purpose) in connection with this Contest or any prize. Prize details and availability are subject to change, in which case a prize of equal value may be substituted at Sponsor’s sole discretion. Prizes consist only of the items listed, are non-transferable and non-assignable, with no cash redemption or substitution except at Sponsor’s sole discretion. Prize winner may be required to provide a valid photo identification, valid driver’s license, or other acceptable government-issued identification to verify identity and redeem prize. Prizes are subject to terms, conditions, expiration dates, and restrictions imposed by the manufacturer/issuer of the prize. No refund or compensation will be paid in the event of the cancellation or delay of any portion of the prize, or any portion thereof. Sponsor will not be liable if an event, or any portion of it, is cancelled or delayed. Sponsor may, in its sole discretion, attempt to reschedule for a future event. Event access is subject to certain terms and conditions as specified by event location. Any terms and conditions for an event may govern if the event is cancelled due to weather, an act of God, an act of terrorism, civil disturbance or any other reason. Exact details shall be determined in the sole discretion of Sponsor. Federal, state, and local taxes on prizes, if any, and any other costs, fees and expenses not listed above as specifically included as part of the prize are the sole responsibility of winner.
Travel-Related Prizes: All travel arrangements must be made through Sponsor’s agent. Any other costs and expenses associated with prize acceptance and use not specifically provided herein (such as security fees, gratuities, luggage fees, meals and transportation, service charges or facility charges, personal charges at lodging, security fees, taxes, and all other expenses not specified above) are the sole responsibility of winner(s). Prize winner may be required to present a credit card at time of hotel check-in. Ground transportation may be provided in lieu of air transportation if winning entrant resides within a 120-mile radius of destination, and no compensation or substitution will be provided for difference in value. Guest(s) of winner(s) must meet Contest eligibility requirements. Winner and guest must possess and show valid travel documents, prior to departure (e.g., passport, visa, valid driver’s license, or other acceptable government-issued identification), and must sign a Release of Liability/Publicity and any other documents provided to him or her prior to ticketing. As applicable, once airline tickets have been ticketed, no changes will be permitted. Sponsor will determine airline, airports, flight itinerary, and hotel in its sole discretion. Travel and accommodation restrictions, conditions, and limitations may apply. Sponsor will not replace any lost, mutilated, or stolen tickets or travel vouchers.
In connection with any visit to the event venue, please be advised that event venue’s policies (including, without limitation, proof of vaccination or negative COVID-19 test(s)), CDC guidelines, and the recommendations of health officials must be followed. In addition, you should be aware of and comply with government guidelines regarding travel restrictions and mandatory quarantines before visiting any destination. Please note that any public location where people are present provides an inherent risk of exposure to COVID-19, and Sponsor cannot guarantee that any person will not be exposed during a visit.
WINNER NOTIFICATION/RELEASES: The potential prize winners will be notified be email or phone after the close of the Contest Period. Sponsor may require winner(s) to complete, sign, notarize and return Affidavit of Eligibility/Liability Release/Publicity Release forms, and other applicable documents, which may require a social security number, to be returned within forty-eight (48) hours of the date and time on the notification. At Sponsor’s discretion, winners may be required to produce picture or some other form of proper identification to claim any prize. Sponsor reserves the right to substitute any prize with prize of equal or greater value. If a potential winner cannot be contacted, or fails to timely respond to Sponsor’s notification, the next potential winner with the most points posted to the Leaderboard will be contacted to award the Grand Prize or Secondary Prize, as applicable. The Sponsor will continue to select additional potential winners until the Grand Prize and Secondary Prize is awarded. If by reason of printing or other error, more prizes are claimed than the number of prizes set forth in these Official Rules, a random drawing will be held to award the advertised number of prizes in the relevant category. Under no circumstances will more than the advertised number of prizes be awarded.
PUBLICITY & MARKETING: Submission of an entry in the Contest constitutes permission to the Sponsor to use entrants’ name, identity, title, likeness, distinctive appearance, physical likeness, image, portrait, picture, photograph (whether still or moving), screen persona, voice, vocal style, statements, gesture, mannerism, personality, performance characteristic, biographical data, signature, and any other indicia or imitation of identity or likeness for purposes of advertising and trade, in any medium, without further notice, approval, or compensation, unless prohibited by law. Submission of contact information in connection with this Contest (whether or not required), including, without limitation, mailing address, phone number, email address during entry constitutes permission for Sponsor to use entrant’s personal information for purposes of administration of the Contest. You also may opt-in to be added to Sponsor’s customer database and to permit Sponsor to contact you in the future for Contest and other reasons. You may opt-out of receiving such communications as set forth in Sponsor’s Privacy Policy (located at www.redbull.com/pp/en_US) or as provided within any such marketing materials (e.g., using the “Unsubscribe” feature provided in the footer of Sponsor’s e-mails). The information you provide will only be used in accordance with Sponsor’s Privacy Policy.
NO LIABILITY & INDEMNIFICATION: By entering this Contest, you agree to release, discharge and hold harmless Sponsor, Sponsor Affiliates, Position Sports, Inc., and their respective directors, officers, employees, agents and assigns (the “Released Parties”) from any claims, losses, and damages arising out of, or relating to, your participation in this Contest or any Contest-related activities (including, without limitation, the concert) and the acceptance and use, misuse, or possession of any prize awarded hereunder (including, without limitation, any misrepresentation made by the you in connection with the Contest; any non-compliance by the you with these Official Rules; claims brought by persons or entities other than the parties to these Official Rules arising from or related to your involvement with the Contest; acceptance, possession, misuse or use of any prize or participation in any Contest-related activity or participation in this Contest; any malfunction, error or other problem arising in connection with the collection, processing, or retention of entry information; or any typographical or other error in the printing, offering or announcement of any prize or winner). The foregoing includes, without limitation, any claim for personal injury, property loss or damage, or death arising in any way in connection with the Contest.
OTHER TERMS: Decisions of Sponsor on all matters related to the Contest are final and binding. Sponsor reserves the right to cancel or modify the Contest for any reason, including but not limited to, if fraud, misconduct or technical failures destroy the integrity of the Contest, or if a computer virus, bug, or other technical problem corrupts the administration, security, or proper administration of the Contest as determined by Sponsor, in its sole discretion. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE OR UNDERMINE THE OPERATION OF THIS CONTEST MAY BE A VIOLATION OF CRIMINAL & CIVIL LAWS. SPONSOR RESERVES THE RIGHT TO DISQUALIFY AND/OR SEEK DAMAGES FROM ANY INDIVIDUAL MAKING ANY SUCH ATTEMPTS TO THE FULL EXTENT PERMITTED BY APPLICABLE LAW.
GOVERNING LAW & MANDATORY ARBITRATION: Any disputes arising under this Contest and/or these Official Rules will be governed by relevant U.S. federal statutes and regulations and the internal laws of the State of California. Sponsor, Prize Provider, and each entrant agree that any such claim or dispute between the parties, or between a party and any agent, employee, successor, or assign of the other, related to this Contest and/or these Official Rules (including the applicability of this arbitration clause) shall be resolved by binding arbitration administered by the JAMS under its rules and procedures in effect when the claim is filed. The rules and procedures and other information, including information on fees, may be obtained from JAMS’ website (www.jamsadr.com) or by calling JAMS at 949-224-1810. Any award by the arbitrator(s) may be entered as a judgment in any court having jurisdiction. NO DISPUTE OR CLAIM MAY BE BROUGHT AS A CLASS ACTION OR AS A PRIVATE ATTORNEY GENERAL, AND EACH ENTRANT WILL NOT HAVE THE RIGHT TO ACT AS A CLASS REPRESENTATIVE OR PARTICIPATE AS A MEMBER OF A CLASS OF CLAIMANTS WITH RESPECT TO ANY DISPUTE OR CLAIM.
RIGHT TO DISQUALIFY: Sponsor reserves the right to disqualify or prohibit the participation of an individual if fraud or tampering is suspected; if the individual fails to comply with any requirement of participation or with any provision in these Official Rules; if the individual’s behavior or communication at any point is disruptive, may or does cause damage or to any person, property, or reputation of Sponsor; or is otherwise not in accordance with all applicable laws and generally accepted social practices as determined in Sponsor’s sole discretion.
SEVERABILITY: If any provision(s) of these Official Rules are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect.
